PALESTINE, April 9, 2013—On April 8, at approximately 11:00 p.m., officers from the Palestine Police Department responded to the 1100 block of West Palestine Avenue, in reference to a possible intoxicated person. Officers arrived on the scene and located a male subject lying in the roadway. Officers determine that the man was severely injured and he had been hit by a vehicle.
With an anonymous tip and help from the Anderson County Sheriff’s Office, Palestine Police located 20 year old David Orihuela at his residence outside the city limits of Palestine. Police also located Mr. Orihuela’s Toyota vehicle. After some additional investigation Mr. Orihuela was arrested for Accident Involving Personal Injury or Death. Mr. Orihuela is being held in the Anderson County Jail on a $100,000 bond.
Failing to comply with section 550.021 of the Texas Transportation Code carries a punishment of up to 5 years if a person (victim) is injured. It is a Third Degree Felony if the victim dies as a result of the accident and the actor does not comply with the above mentioned section. Mr. Orihuela could also face additional charges.
The name of the victim is not being released at this time.
The investigation is still ongoing at this time. This includes whether or not alcohol may have been a factor in this incident.
