Ben Wheeler man arrested for Capital Murder

VAN ZANDT CO., March 26, 2013--On March 24, at approximately 6:00 a.m., the Van Zandt County Sheriff’s Office received a 911 call from an individual, later identified as Larry Maples, 44, of Ben Wheeler, stating that he had just shot his wife and her boyfriend. Deputies arrived at a rural residence located at 2641 - FM 16 west of Canton a short time later and arrested Maples at the front door of the residence without incident.

Investigators determined that Maples had arrived in the area of the shooting in the early hours of the morning, parked his pickup a short distance from the scene and walked to the home on foot. Maples, after seeing his wife’s vehicle parked at the rear of the home, entered the residence through an unlocked door. Once inside the home, Maples shot the owner of the residence identified as Moses Clemente, 47, of Canton, following a brief altercation. Maples then shot and killed his wife Heather Maples, 34, of Ben Wheeler.

Clemente was transported to Mother Francis Hospital in Tyler where he was treated for a single gunshot wound to the abdomen. He is listed in critical condition and is expected recover fully.

Heather Maples was pronounced dead at the scene by Van Zandt County Justice of the Peace, Precinct One, Don Kirkpatrick.

Van Zandt County Sheriff Lindsey Ray contacted the Texas Rangers, the Van Zandt County Criminal District Attorney’s Office and the Smith County Sheriff’s Office to request assistance with the investigation and the processing of the crime scene. Search Warrants were issued by 294th State District Judge Teresa Drum to search the residence as well as Larry Maples vehicle. A third search warrant was issued to search Larry Maples residence in Ben Wheeler.

Maples was transported to the Van Zandt County Jail in Canton where he was confined for Capital Murder.

Sheriff Ray stated, “We are absolutely convinced that Larry Maples acted alone in this horrific crime. This was a senseless murder that will affect many people in our community especially this family. My heart goes out to this family.”

Maples was arraigned on Monday morning, with the following charges and bond:

Capital Murder - no bond

Felony 2 Aggravated Assault with a Deadly Weapon - $100,000.
